Certified mailing return receipt shows HPD Police Commission received the 7 page complaint on 3rd July 2023 reporting the police assault for investigation and the withholding of police video recordings and associated police information.
By August 2023 Steven Magee had not received a response from the HPD Police Commission and they are still withholding the police video recordings and associated police information.
On 10th September 2023 he receives an invite to a 'closed session meeting' later in the month. They are still withholding the police video recordings and associated police information. This is his 'closed session meeting' 5 minute limited statement:
"I am author Steven Magee and I witnessed a Hawaii Police Department officer assault a person that was pinned face down by two police officers with his hands handcuffed behind his back. My car video camera also recorded the assault. I have reported the assault to 911 and they have refused to investigate it. Hawaii Police Department is refusing to release their video recordings regarding the incident, even though the police officers stated they were recording it with body cameras. The incident took place in a public place and under Hawaii video recording laws they should be released to the public. There is no legal right to privacy in a public place in Hawaii. The person that was assaulted wants the media contacted and has waived his rights to privacy. I have also waived my rights to privacy. There is no legal reason I am aware of for these video recordings to be withheld from the public. Police video recordings are supposed to be used to create transparency. In this instance they are being used to create suspicion of the police department because they appear to be hiding a police officer assaulting a member of the public and this is illegal activity. I am requesting the Police Commission do a full investigation of the assault and a full release of all video recordings to the public with no redactions. Failure to do so will severely undermine this police department’s reputation with the public."
